These sometimes can take a bit longer and sometimes require extra patience from both you and the borrower(s). You may also need to determine capacity of the borrower to understand the documents, particularly if he/she is on a strong pain killer. You might even ask him/her (if able) to write a brief explanation before proceeding as to why you are there. It helps to explain why you are asking. Go with your gut instinct is what most will tell you on that issue (but check it out in your handbook and SOS office if need be as suggested by Linda).

It sounds like your communication with him is going to be through nodding and shaking the head and through hand signals and he'll probably sign with a mark (X) if he can't sign his name. Check your handbook for how this should be handled and, if your handbook doesn't address it, call your Secretary of State.

I had one that was eerily similar this past weekend and, thankfully, Florida's handbook is very clear how to handle these types of situations, mine a piece of cake - well, that and the good advice from a fellow Florida notary.

I was asked by a family member for a patient in intensive care in a hospital if I could notarize a POA. The patient has cancer. He can nod (for purposes of determining if he is aware, willing, understanding) but cannot speak due to a tube in his throat. He also may have a labored signature. Are there any guidelines for this type of signing?
