jennefer_in_va: Hello, I am a notary in VA and it is not required to use a seal on VA documents. However, if notarizing out of state docs i have to use a seal. i need to know if the seal can be an "ink seal" or does it have to be an "embossed seal"? any help would be appreciated.
jbelmont: I can't reply because VA notary law and CA notary law are completely different.
dfye@mcttelecom.com I personally swear by the embosser. The ink seals can tend to smudge; or if they get wet. . . The embosser never disappears from the paperwork. You should clean your seals regularly no matter what kind you have.
As for seals not being required in your state, it would be my practice to use one anyhow. If you were signing just one or two pages, that would be one thing, but you are signing a complete set of documents. Many borrowers like and appreciate the official look of the seal on their documents. There can be no doubt you notarized a doc if your seal is on it. Many lenders also will require you to seal the docs regardless of what your state law is. I recently did a dual signing (two states, one notary per) where the docs were not sealed by the original notary. She stated that seals were not required in her state. I sealed my docs as we are required in New Hampshire. What happened was the docs were sent back to the original notary for sealing since they did not look right with just one seal on them. In turn this held up the borrowers funding. Everything needed to be consistent with both states.
If I lived in Virginia or any state for that matter, I would personally want my documents sealed. One of the things that validate us as notaries in New Hampshire is the official seal and I am very proud to use it.
Forgot to mention that if anyone gets your commission information, which will happen if you notarize docs, your signature can be forged. If you make a practice of using your seal, it is impossible for someone to use your name and get away with it. Yes, one of my employees had it happen to her as a Justice of the Peace as we are not required to use JP seals in New Hampshire. Someone got ahold of her information and forged her name to a legal document. She almost was unable to prove the forgery. With a seal, there should be no doubt at all. I make it an absolute rule to cover my @## with my seal. |
