There is being diligent and then being ridiculous. Make sure you value your time more than anyone else's. The nice thing about being the only one in a rural area is that THEY have to change to your time schedule. As the saying goes, "Poor planning on your part doesn't constitute an emergency on mine." I would never ask a borrower to sign that late either, unless they begged me too. Then my fee would double. The best way to not have to deal with these sorts of situations is to not get yourself into them in the first place!

Update and lesson:

Whenever a fubar like this occurs always remember that the Lender and the Borrower are innocent parties when the signing companies mess up.

If you find yourself in a position of having to defend yourself because of the unprofessional conduct of a signing company make the "appropriate" apologies.

The situation may not be your fault. But, calling the loan officer to apologize for anything that may have been avoidable by you or whatever lets the lender know that you take responsibility for yourself and recognize their position in the situation. Always ask the lender to extend your apologies to the borrower as well that the situation occurred.

I just got a call from the processor at the lender to tell me that I have been scheduled for the closing. I apologized to him also and told him that I do not have a confirmation at this time. But I am keeping the time open and will perform the closing, I only need Docs.

What a mess, caused by one unprofessional signing company.

On Monday I had a closing cancel with JMT because of late lender docs. When they called to reschedule for 6:30PM I informed them that I was going to be a couple hours away at another closing and could not make it. The earliest I could depending on road conditions, etc. would possibly e 9pm. The in their wisdom did not schedule the closing with me. Of course, there was no other closer to schedule it with. Rural areas are that way.

Then I get a call from Sally at Skye. I told her the same thing. She said she would get back with me. She did, to leave a voice message that the docs had been uploaded. NO confirmation. No one to call and say I can't do it. NOTHING! AND, I did not confirm with them that I would do it.

But, the diligent notary that I am, I tried to make it before midnight. I couldn’t get ahold of Skye at that time. They didn’t answer. Then I called the husband from the JMT information at 8:30 to tell him that I was still a couple hours away. The husband goes to work at 10PM but could make arrangements to meet me at work.

By the time I got home, printed the docs I could barely make it by midnight to maintain the date. NOT a pleasant experience.

I had a text from the husband that the wife went to bed and they would call the lender in the morning.

Skye still maintains that they confirmed the closing with me and since I printed the docs, even though it was late that it's proof that I had accepted the closing.

Long story short, The Title Company is finally figuring out that I tried my best. After more than 10 years working together I would think that should be evident. But, Skye still maintains that it's entirely my fault.

It's nice to know from this site that they are having money problems. Did you know they have a Full time attorney to deal with the crap they pull? I don't know of any other signing company who has a full time attorney on staff, in their office. Of course, that’s an assumption based on having to call the main number so the manager could transfer me to the attorney.

So, protect yourself from them. Apparently they are heading to bad place and are risky to work for. And I’m not just trying to get paid by them, they will trash anyone to get business.

I'm sure they were trying to get more business from Title Source and more than willing to trash my reputation to do that. Well, let's hope this has backfired on them.

Their greed has caused me irreparable damage with my clients. But, hopefully they will look back at our history and determine the truth for themselves.

I still have not received a single apology.
