Sometimes you can save the settlement company some money by understanding information like this. It is not probable that you can get all the recording info you need on-line, but at a minimum, you should know the recording requirements of the counties you service forward and backward. Another example is using a bit of foresight in preventing problems from occuring. I had a deed in package from husband and wife fka maiden name to themselves as husband and wife. I was able to copy the signature page from the mortgage she signed in her maiden name and put it in with the package. I had to notarize a combined signature, Jane Doe f/k/a Jane Smith on the deed. She only had married name id, but I was able to compare the signature against the existing signature for an identity match. I pointed out the procedure to the settlement agent when I returned the package. I think it may give my business a bit of priority over my competition who may have to call from the closing with and id problem.

Caution - within the recording requirements are further specifications for font size, and reducing the font might also get a document rejected.

I disagree that it's not our 'job' to know recording requirements, as it can make/break a mortgage/real estate transaction if the documents we've been hired to have executed end up non-recordable.

While the recording statutes are set by each State, each county or recording jurisdiction is free to interpret those & implement them accordingly. I've yet to run into a county recording office that does not post their recording requirements on their website.

I've been using the Acknowledgements I print from a CD-ROM I purchased from Notary Classes dot com's website. I wanted to let other notaries know that their forms do not consider margin requirements, such as in King County Washington, that get rejected and charged a $50 refiling fee.

The requirement appears to be slated to get additional fees as a scam by that county but an agency person told me this kind of thing happens all the time, including in certain parts of California.
