Make sure you have Errors and Ommission insurance in case anything does happen. You can't stop people from suing you so E&O insurance is very helpful.

Sure... not that it would be lawsuit-proof, but it can contribute to stopping a problem before it starts. Also, it may be possible that as an attorney, you are held to higher standards and claiming 'just a notary'???...I dunno, just a thought.

Also..we are notaries; we don't 'do notaries', we notarize signatures.

If you don't value your time and experience, nobody else will.

I am a new notary as well as a new attorney in Louisiana. I started doing notaries for extra money six months ago right after I was sworn in. A Notary/Attorney I know was recently contacted by an attorney regarding a Louisiana signing he did in 2003. From the little facts given to me the signing was for a 3rd mortgage and borrowers thought the lender was going to pay off the 1st and 2nd mortgages. The lender did not pay off the 1st and 2nd mortgages and now the signers are coming after this notary/attorney since the lender is no longer around.
I would like to insulate myself from this happening to me in 10 years. Is there anyway I can have each borrower sign a form stating I am acting only as a notary and cannot be held liable for a lender's failure to uphold their obligations?
