A false name can be given by a person when they're first arrested - along with a made-up SS# and DOB, certainly.

That identity information is (I'd assumed, but researched to verify) cross-referenced with the DMV's data upon arrest - which includes a photo, physical description, DOB. This is the first 'sieve' through which most false identities would be snagged.

SS# are easily verified through the SSA - would have the name and the date the number was issued. Sieve #2.

If 'Suzy Snowflake' presented herself upon arrest as never having obtained a D/L or a SS card, I have to imagine that would be a pretty doubtful but perhaps often tried story.

"Criminal Identity Fraud" (as it's called) does occur, but must be fairly well planned out by the perp prior to arrest. They can assume the identity of someone else whom they resemble & who also hasn't been processed into the criminal system; whose SS# and DOB the perp has memorized. They would also need to ensure they are not possessing their OWN ID or items that could identify them (cell phone) on them when they're arrested. That's a lot of planning, but most certainly does happen. If the plan succeeded, they would emerge from the prison system with a false release id.

"In 10 states, what the DOC issues and claims can be used as proof of identification to obtain state-issued ID is not listed by the DMV as acceptable proof of identification. For example, in New York there is a Memorandum of Understanding (MOU) between the DOC and the DMV that corrections documentation together with a birth certificate and social security card fulfills the identification requirements to obtain state-issued ID. In practice, however, the New York DMV has a daunting six-point system for proof of identification, which does not list any form of corrections documentation as an acceptable proof of identity."

Unless the convict's prints are on file, the person is an unknown. They can say their name is Suzy Snowflake. Without proof to the contrary that is the name that will be used. Not everyone has their fingerprints in the FBI database. You say the SS and DOB can be easily verified - but how?

It is missing one element that some states might require for our purposes - a signature.

I find it pretty difficult to believe that a person could pass through the prison system on a phoney name, since both the SS number & the DOB would be easily verified - but then, I certainly lack first-hand experience at it!
