I agree with Diananotary, I am also in Ca. I used to get worked up and upset about how to handle this one,make lots of calls, fool around talking to a lot of people etc etc etc, but not any more. I am not the police and the state is my only boss. They can satisfy the lenders/titles request to sign how its printed on the line but in my notary acks and jurats, the name on the ID is what I am notarizing. If it doesnt match, not my problem. Since I have been doing it this way,all year now, I havent heard anything from anyone. Before I used to spin my wheels, trying to do it in a way that satisfies everyone in the process,calling everyone to see if they wanted to redraw, sign and initial or do it as aka, getting into long explanations, debates with loan agents, title people signing agencies etc, wasting my time and being seen as a trouble maker in the end. So my advice is dont trip- just do your notarizations in the name that is on the ID or if you want to fool around with credible witnesses who usually dont know a persons middle name etc anyway, then go ahead. |

from time to time i get instructions from title/escrow - "make sure the borrower signs his/her name exactly as it appears on the documents". As far as i am concerned, the borrower can sign as he/she would like, but i will go with the name on the id/dl or passport when completing the jurat or acknowledgement. So, yes, when notarizing Mr. Johnson's signature, i would go with the name on his ID.

I agree with you - I'm thinking someone goofed when title was vested and no one ever caught it. If he holds title incorrectly, then THAT's what needs to be fixed.
George Daniel Johnson and Daniel G. Johnson could be, and probably are, two very separate and distinct individuals - just google both names and see how many hits you get.
If he had no ID in the name of Daniel G. Johnson, I would not notarize....and no, in this instance I don't believe you can use Credible Witnesses.

This is one that I haven't came across before. Got an opinion from NNA on this but still would like to hear what you guys have to say. I am in CA. Borrowers name was lets say George Daniel Johnson this was on his DL. The docs were drawn as Daniel G. Johnson? What would you do?
I asked for the docs to redrawn with the name on his DL.
The borrowers name used above was made up.
