On an I-9, you are not stating that you are the employer's employee. It is a statement that you are the employer's representative. Big difference. In the signature block for the person completing Section 2, it states: "Signature of Employer or Authorized Representative."

Typically, employers hire notaries as their representative because of the integrity they are suppose to have and experience in validating signers and identification documents. When I am asked to do them, I also request that they send me a letter or memo, on company letterhead, authorizing me to act as their representative. Never had any problems with employers or employees nor getting the requested letter.

Now, if the OP is really asking about completing a W-9 (Request for Taxpayer Identification Number and Certification), then my response is that it is NOT notarized. The employee must complete it themselves and provide the completed form to their employer.

I am curious why would you sign or fill out this section as the employees employer when you are not??? I had one of these that specifically stated if the notary was not willing to fill out this section then just cross it out and have them notarize the employees signature as requested.

I have done quite a few I-9 Forms.Employee fills out section 1. You complete Section 2 and sign as the Employers Representative. You then fill out an Acknowledgement for the Employee.

Maybe it was an I-9, which is employment eligibility verification. There still isn't any place to notarize on that form. Do a search on this site and on NotaryRotary for the I-9 to see how others have handled it.
