Well based on everything I heard today about loan modifications, and the fact it definately was a loan mod application after reviewing the doc and putting 2 plus 2 together, I called them back and turned it down. Needless to say, they were not very happy with me.But, I will be able to sleep tonight! Thank everyone for your help and support.

Yesterday there was a thread about Notary Pro on the other forum - apparently they are very slow to pay. Someone posted she had done 6 loan mods for them and was still waiting for payment on all. Someone else posted that she just received payment in Sept. for a job done in April!!!

I would turn the job back just based on Notary Pro's payment rep!

Thanks for all your help, I hope I am doing the right thing here, I do not like the fact that we could be put into a "scam situation" and Should'nt Notary Pro(they Ordered it) know better. I reseached them and it was all good comments, why would they send me something like this,if it is a bad thing?

Corporation info below was found on the CA Sec of State Business Portal. Seems like the corp is pretty new - my experiences have found that this is usually not a good sign. Address listed here is different than on their website, but registered agent is same as the attorney listed on the website. I did not find any negative info about this law group on the internet, so that's good.

Dawn, this really sounds like a loan mod application with up-front fees paid by the borrower. Requiring up-front fees for foreclosure rescue services became illegal in my state of Virginia as of July 1, 2009, so I personally would not do this appointment. I don't know what the laws are in your state.

Do a search for "loan mod" or "21st Century" on this forum and also on NotaryRotary.com. I understand that 21st Century is not involved in your deal, but reading the posts about that company will give you a better understanding of the reasons why many notaries will no longer accept these types appointments.

I did a loan mod application in March for an attorney's office. This was before I really understood what bad news these things were. Actually, it wasn't an application but was an attorney-client retainer agreement, but it was for the purposes of loan modification services. It was one of the hardest invoices that I have EVER had to collect on!!!!

Do a search on both notary forums for Spectra Signing Services or Financial Solutions Law Group to read about that saga!

The borrowers are paying $2995, they sound really nice, I do want to be apart of a scam if this is one.

Dawn, if it's a loan modification application, just be aware that many of us notaries have chosen not to accept these types of appointments. The reason is that so many of them are scams where homeowners give money up front to the company that is promising to modify their existing loan, and the check gets cashed but the promised loan modification never materializes. By the time the distressed homeowner realizes what is going on, they are behind in their mortgage payments.

What is the name of the company that hired you? Does 21st Century or Fidelity have their names on any of the paperwork?

If it's an actual loan modification agreement from the lender that spells out the already agreed to terms, then those types of appointments are no problem.

Leave pages 1-11 with Borrower.
IT says borrower to provide a copy of their mortgage statement billing. To return that along with the following:
Attorney-Client Foxed Fee Agreement
Third Party Authorization and Acknowledgment
and the Check.

Maybe it is the application because there are places for them to fill out personal info and sign on the pages 1-11

Hi Linda, I am not sure now, I am so confused. There are not many doc's and it looks really easy. How do would I know,and what is wrong with doing the app?

Hi,

I am so nervous, I have my 1st signing today at 4:30, it is a Loan Modification. 20 Pages total. I need to return 9 pages along with the mortgage Stmt, check and the last Page I have to notarize with an acknowledge. Can anyone tell me what doc's are in a loan modification or if you can give me any help, clues, tips, I would appreciate it, I am panicking here
