Few things come to mind - perhaps there's a glitch in the SOS office - so new they don't show up yet?? Advertising inadvertently preceded their commission?

Interesting question. It likely gets back to an ethical consideration more than a legal one in my opinion (but, I am not an attorney). For example, would a newspaper allow you to call and advertise your services as an attorney without verifying your claim and or standing in the profession? Or most any other service for that matter.

Early on, a few signing services asked me for a copy of my stamp and commission and two of the title companies I work with completed background checks before any assignment was provided and two more accepted the NNA background check.

But, to answer your question, no, it does not look like a person would be required to be commissioned to find a way to advertise a service. If a part of the question is should the advertiser be required to determine the qualifications of a notary before allowing them to list, the answer, in my opinion, is no. The onus would be on the person making the advertising order, rather than the person accepting it. To actually accept an assignment for that service without the necessary skills/tools to complete the assignment would be an additional matter. Further, the SOS of a particular state and/or the attorney general (or other appropriate authority) may want to look into the matter further if it was reported. Or did I misunderstand your question? Would it be more appropriate to ask if the signing service or title company be required to check the qualifications of the people that they are hiring to perform work, even as an independent contractor?
