Unfortunately, I would have to say that I am finding the same situation in regard to receiving payment. We are now broaching the 90 day mark. Several requests for payment via voice, email, office phone number, cell phone, and fax have been made since December 30th, 2009. A W9 was never requested by Eric Logan, but I included one just in case that might be the reason he has not been able to issue the payment.

Considering I have been in business successfully since 2003; I never like to negatively approach a collection situation until all avenues have been exhausted. I would prefer to remain professional despite the fact that 90 days is fast approaching. I am sure Mr. Logan can not do business for free; and neither can I. Therefore, the obvious solution is clear. Payment.

I see that from time to time you visit this board. There is no mis-understanding. I managed to catch you on your cell two weeks ago and got an apology from you in regard to waiting as long as I have for payment. I sincerely appreciate your apology, now I would like you to keep your promise. So now, I would appreciate payment. Please contact me regarding payment. I have sent another invoice/W9 today via fax and email.

This indeed was our mistake. I voluntarily paid Mr. Miller a $50 late fee, which he can verify.

Good point, Linda! I had forgotten about the Georgia attorney-state caveat.

I don't normally disagree with Linda but I have to here...sort of:

If these are loan signings you did, being as GA is an attorney-only state, I'd think twice about contacting the GA bar about this....they'll likely tell you you're not supposed to be doing loan signings to begin with, so not sure how much help they'll be - not to mention what sanctions you may be subject to, if any. If it's not loan signings you're owed for, but regular general notary work, then yes, the GA bar may be one avenue for you along with small claims court.

Now, on the other hand, if you're an attorney (and therefore doing loan signings legally) you already know how to handle the non-pay situation.

Good Luck!!

Look up the GA State Bar on-line and find out how to file a complaint. I just did this with another attorney in CA, and faxed a copy of my complaint letter to the attorney's office along with a note on the cover page saying I was planning to file the complaint the following day. Got an e-mail within 5 minutes promising my payment to be FedEx'ed to me.
