You should not have any problem if you don't write in parish. Regarding the witness requirements: They can nearly always provide witnesses if you push it. I tell customers that they need to inform the borrowers of the witness requirements. They just don't want to do it because (generally speaking of course) they don't want people in their business. When I explain to them that they will not see anything but the signature page and that the witnesses come at the start or end of signing, they are usually more receptive. I try to have them come to my house if I am providing witnesses. That is the trade off to me. I stay home and they don't have to provide witnesses. Win win situation. Further, I will only ask friends and family to come along for an additional fee if they are going to my job with me. What parish are you in? |

So then it would be ok if it said County of Jefferson and I didn't change it to say Parish of Jefferson?
Also, most of the borrowers I've come in contact with are unable to provide the required 2 witnesses so I've been providing them. I check with the company first and ask the borrower if it's ok. Do you ever provide witnesses? Also, do you get a fee for doing so? Thanks

It depends on where it is. Sometimes I put "East Baton Rouge Parish" on the line. When it is State of______________, County of ___________ at the top of the page, I will draw a line through "County" and put the same information as above on the line. There is no actual requirement for us to do it any specific way. There are some companies that tell us not to change it, which is fine. Hope this helps. Notaries in Louisiana have much more freedom to prepare documents, etc. We can and do prepare wills, trusts, mortgages and more for our customers. |
