1. You can either amend the certificate on the document to comply with CA law or, as you said, line through the cert, write "See Attached" and attach a CA compliant Ack or Jurat.
2. The party that has to appear before you is the party whose signature you're notarizing. If you're notarizing both Buyer and Seller Signatures, then both need to be there.

And don't forget - even though this is a co-worker and someone you know, "personally known" is no longer allowed in CA - you MUST obtain proper ID...

I need advice:

I have a set of transfer of ownership documents already bound together with both an ack and a jurat but neither has the 2008 mandatory wording. Do I draw a line though the incorrect wording and say see attached? These are for a coworker and the documents were sent to her from the buyer who is also a real estate agent.

And do both parties (buyer and seller) have to be present? The only thing that needs notarizing is a Name Affidavit and Correction Agreement Limited Power of Attorney.
