Yup..yup....I have one of those...a small town south of me is in 3 different counties...another small town farther south is in two (or could be 3) counties...I ask the same thing...what county will we be sitting in?

One particular city I go to often sits in 3 different counties. I jokingly ask the borrowers, "What county are my feet in". They laugh and what they tell me is what I use. Always use the county you are physically in, no matter where the property is.

Yes...cross out the "Downstate" county up top and insert the county where the document is signed.

O.K. thanks again. I not only have a hard head, I'm also not so smart as you can see. Example: Page 15 of the mortgage. Up top it says "State of Michigan" "Downstate" County ss: Below that is: The foregoing instrument etc Mr & Mrs so and so etc., etc. There at the notarization area I crossed out where they had typed in "Acting in the County of "Downstate" and initialed. Then i did my normal thing acting in my county. So what you are saying is, also cross out the downstate county up top where the property is located and change to my county, right?
I figured I was doing wrong notarizing page 14 on the mortgage but nobody ever questioned it...

Okay...no...<G>...maybe I'm not so clear.

The county in the certificate should be the county where you're sitting as well as the "Acting in" portion to be filled out - you're acting in the county where you're sitting..

All notarial references to county are the county you're sitting in...you live in county A...property in county B...loan signed in county C ...venue is county C and you're acting in county C. So if any other county is referenced (which happens when they generate the docs) you should cross that out with a single line through it, print the correct county (location of signing) and initial the change.

IMO, signing the last page of the mortgage is sufficient - you don't need to notarize on the page where the signatures are unless you have specific instructions to do so by TC or Lender.

Thanks for the reply Linda! I guess I didn't make myself perfectly clear. Picture this. I did the signing in northern Michigan, they live in southern Michigan. I met them at their summer place (20 miles from me) The County mentioned at the top of the page is the County where they live and the loan is for that place downstate. I know that I am Acting in my County and have that o.k.. I just am not sure about the County where they live, I think I leave that as is.??
In regards to the mortgage, page 14 of a 15 page mortgage is the signature page where they sign. (I know that you know that) and the last page asks for a notarization. I have always notarized both pages and I think I only need to notarize the last page even though the signatures are on page 14. Also on page 15 it says "State of Michigan" County of (Downstate County). Can this stay as is and then on my notarization use "Acting in etc)?.

The county in the venue (county of _____) is where the notarization is taking place....e.g. they own the property in Smith County but are signing in Jones County....would read State of Michigan, County of Jones (or Jones County)...you're also acting in whatever county you're in...so yes, correct the venue.

As to your other question, you're not notarizing pages, you're notarizing signatures..and only one notarization is necessary IMO...

Boy I hope they either traveled the 300 miles to YOU or you got paid really well to do this..:)

In regards to a "Compliance Agreement", "Owners Affidavit" and other documents. I did a signing yesterday for a couple who live 300 miles away in another county. Where it says "County of" it is typed in that county. Now when I notarize I write in "Acting in the County of (My County). My question is, should I cross out their county at the top of the page? The loan was for the house 300 miles away in their home county.
My other question is this. On the next to last page on the mortgage where the client signs, do I notarize that page and also the last page?
I have always notarized both pages but is that necessary?
