I really appreciate everything you all have offered as very good advise. First I would like to say it is certainly not the money. I actually wish I had a dollar for every advertiser who didn't pay me in my other business over the last 25 years but thats another story. The fact is I did extensive research in my effort to do damage to Ancero. I contacted someone who uses him as a reference and got this e-mail in reply:
quote: I am sorry I cannot help you. I have been working with Francis for a long time and he has always paid me on time. We did hear that he ran into some terrible difficulties in November of last year (non-payment from lenders etc.) and as a result lost his business and his home. He still owes me quite a bit of money and I know that if he could have paid us he would have. We did run into some real scums last year when we were not paid almost $2,000 by companies who knew they were in trouble and kept on hiring notaries with the intention of never paying them. Sorry I cannot help you get in touch with Francis. If you hear from him, please let me know.
If this is true and he has actually lost a home over this... I feel like he is getting what is coming to him (I hope). Although I do realize that I was hired on December 7th which of course makes him more of a @#*^%X (is that better for you J.)
I have to confess that I have been sort of lucky during all of this as I have not been paid a total of 5 times since I have started. 3 of them you know about because of my postings, ESS for $100, LDSS for $350.00, this guy for $100, a local company that went out of business a year ago for $100 (long before the market crash) and a Title Co in Georgia $250.00 (like a year and a half ago). judging from all the terrific loses I read that other notaries have experienced; I'm probably dam lucky. But it doesn't change the level of frustration and anger I experience when I have been RIPPED OFF and more importantly (to me) WRONGED!!!
Jeremy, I don't think any amount of collection letters and threats are going to collect my money, unless he goes to them personally to break some legs (I would if I could afford it). If he does I will be glad to pay him because as I have stated before, it's my twisted sense of revenge that needs satisfaction. Three of those five companies are now out of business, one is in canada and untouchable and the other would die before he pays me because I probably cost him thousands seeking my retribution.
So Carmen, in the end it's really not about recouping my fee. It's about that eye for an eye.
In conclusion I will share that this experience over the last 3/4 year has been quite disheartening and I have begun to turn down SAs and have been working more in my other business and will only accept signings from TCs. Perhaps this will help in some small way to get the message out that working for SA's is a risk for all NSAs and more of us will take the same approach making SAs less usefull.
Just as an after thought... it occurs to me that if a communications campaign were created to alert Title Companies that using Signing Agencies is detrimental to them in the regard that if we were hired directly they would receive a much higher level of work, they might respond. I find that the Title Companies who have an in house scheduler and pay better than SAs do much better with the entire process. Example: MIS, Equity Title, Fox, etc. I know that may be a pipe dream but if someone had the time and energy perhaps a few minds could be changed. Just an idea. |

I can remove free listings, however, I would only remove one if they caused a major problem as a notary. If they caused a problem hiring notaries, their listing does not contribute to that problem so I would be penalizing someone in a way that didn't make sense. Why not contact a collection company or an attorney to get your money? |

Kelly is right; start your collection efforts. I understand your anger. But you need to concern your energy for the collection grueling collection process. BTW, he has a free listing so I will mention it to Jeremy ands see if we can have him removed. (He does frequent this board so he may just read this anyway).
Good Luck!!

Peter - it's clear you're upset and I don't blame you. But this kind of talk is not going to help you get paid. You must use ACTION and by that, start your SERIOUS Collections Efforts Today.
Remember that what comes around, goes around. This guy will get his. Additionally, it's only money! Yes, yes, we ALL need money but it's really nothing in the grand scheme of things and Peter, this is a part (a crummy part!) of our business. Try to recollect all the times the money was easy and it was such a pleasure to work with our wonderful clients!
Okay, off my box and good luck to you! Kelly

Obviously he is listed and has paid for his spot on 123. The thing is he owes me and a bunch of us a lot of money, and is not paying. He is dirt. And as far as I am concerned, I wouldn't mind if he were hit by a bus tomorrow. Is there anything you guys can do (like remove his listing - I wish) so he can not continue accepting and giving out signings through this site?
Frances, If you read this... DROP DEAD! |
