I don't know VA notary law, but in Florida, we are allowed to swear in people for phone depositions. I have a jurat form on my website that might help you...or at least give you a place to start and ask questions. Below is a link to the deposition jurat I use.

When on the phone with the Judge, politely ask:
"Your Honor, As the notary public, what documentation would you like me to send to the Court and at what address?"
This is a common opening line used to learn what the Court or the attorneys representing the parties want without admitting you aren't sure what to give them. |

Just did exactly that yesterday. All you have to do is properly ID the person & swear 'em in when the 'court' is on the phone. |

Hi everyone. I'm relatively new to the field and received a call the other day from someone who needs me to come to her house to verify her identity for a telephone court hearing. It is a child support case. Apparently, the judge will be on the call. Obviously, I will receive proper identification and then what? I'm in Virginia. Does she need to sign anything? If so, what? Certification? (certifing a copy of her driver's license) And would I mail it somewhere? The client did not know what would be required. I don't want to go out there...lost. Any help would be greatly appreciated! |
