If the notary fee was listed on the HUD, it would fall under RESPA laws which state the borrower is not responsible to pay any of these items unless the loan funds.

Many talk of wanting to have their fee listed on the HUD. That does not make a guarantee of payment for services rendered. It only places the NSA under the same provisions as everyone else that 'no one gets paid for services rendered unless the loan funds', except the appraiser.

If you were listed on the HUD and the loan funded then you may have more of a leg to stand on. The title company is responsible for dispersing all funds. I would have to agree the borrower did not solicit you for this service the title or SS did. They are responsible for payment, not the borrower.

The borrower has already paid your company for your services. It is your company that is
responsible for payment to you.

Hello Fellow Notaries:

I have an outstanding invoice for a trip and print fee, as the loan was cancelled at the table due to higher fees than was originally disclosed to the borrower.

I would appreciate your answers. I believe the borrower is the one who should pay the outstanding invoice as he received the service and it was disclosed to him as one of the costs associated with the loan. Somewhere I read (of course I can't find it now) that this is a violation to request payment from the borrower when they did not order the service (the lender did).

I tried working with the lender to collect and after several weeks, they told me to go after the borrower. The borrower believes the lender should pay.

I appreciate your answers so I know who to pursue legally.

Help, need to know what to do about a signing company that doen't pay . I have a total of four outstanding payments total $375. since May . Should I report this to the BBB? At this point he will not answer my calls, sent letters, faxes. and no response. I'm not even sure if he has a company the name is M. David Spear in Midlothian, Va. I understand that he is an loan officer. Has anyone else had a problem with him.
