I really don't know about any law in any state, however, I won't take a picture of a borrower's ID, whether with my phone or my own camera. If, for whatever reason, that borrower's ID is stolen, I don't want my name coming up as a possible "person of interest". |

I have recently been informed by another notary that it is a federal offense to take a copy/picture of a state identification card. That this has always been a law and that CFPB is just starting to enforce it. The only law I can find states that it is a federal offense to make a copy of a Military and Department of Defense ID. I knew this, but I can't find any federal law that states that it is illegal to make a copy of a state id (I don't think the feds can enforce a law about state IDs, but I could be wrong).
So, do you know the answer to this question? IF YOU DO, please provide your source. If it is a state law, please provide which state you are in.
