I give my clients a disclosure in regards to my job discription. Along with that, I have a hold harmless agreement that they sign. If they decide not to sign or stop in the middle of the signing, I also have them sign a notice of refusal to sign. This way I have some documentation that I was there and I have a better chance of getting paid. I wish I had this one at the first signing that I had.

There is one company that includes a Hold Harmless form in every packet and of course the borrower signs the form. My question was wondering if all agents needed this protection by providing their own forms. Does anyone know what this form protects the agent from anyway? Frankly I don't agree that the borrower should sign any paper that requires them to pay the notary fee. The signing agency should incur this cost as the risk of doing business and be prepared to take up the gap when a closing falls through. You are right Carmen, they would probably balk at a contract that binds our fees.

I have heard of some notaries that actually have an agreement typed up for the borrowers to sign that specifically state that they will be responsible for payment regardless of the outome. I don't know if this is legal or not. I a sure however that the signing companys won't like it at all.

Should we purchase our own Hold Harmless forms and have one signed at every closing? And do we create our own Contractors Agreement to protect against a paltry compensation for a cancellation. I went to a local signing and about a third way thru the borrow decided to cancel the refi..I was with this borrower for an hour waiting for his calls back and forth. The signing co. wanted to pay me only $30 travel fee. I said no way as he had signed about 1/3 of the documents and the time involved. I stuck to my guns and am curious to my actual paycheck. Someone on the forum had suggested our own agreements to stop this paycut.
