As I call to confirm appointments I am finding out that borrowers are not being given the Closing Disclosure 3 days in advance as I thought was required by CFPB regulations. More often than not the borrowers are seeing this at the closing table for the first time.
If the CFPB final regulations were being followed as prescribed by the regulations, then
1. We should be getting signing docs 2-3 days prior to the appointment.
2. The borrowers will have been aware of the closing costs, fees and any funds they need.
3. For signers, we should now be able to determine pricing based on number of pages and type of signings we are given (Conventional, VA, FHA).
What we are still seeing are closings scheduled hours and not days prior to signing; signing companies still telling us they don't know number of pages or what type of purchase or refi we are dealing with.
In order to price out a package, we need to have this information. If not, how are we able to function profitably. This business only works if everyone involved can make money.
