Here is a suggestion I would like to propose that you make available to your notary subscribers.
I have experience in debt collection, one of the tactics I used in that experience of collectinng from scufflaws worrked as follow.
I would acquire unpaid debt documents from clients, ie, Dr,s, a comuter airline, a movie chain. I would offer my collection services for a percentage of the amount due, payable only if I collected. Clients would sign a agreement to the above stipulations.
My best success was collecting on bad checks issued to the commuter airline. I would obtain a document from the client assigning the debt to me for collection. I, as the owner of the debt would send certified letters to the debtor stating my interest in the collection along with a demand for payment within 15 days, failure to pay would result in legal action. Most debtors paid, the ones that did not had small claims charges filed against them. I had to pay for the Sherriff to serve the debtor, that fee was added to the total demand in the small claims court. I had a verey good success history with this proceedure. In Florida I was able to collect three times the value of a bad check. I would also ask the Judge for a time compliance order, this would subject the debtor to contempt of court charges if not complied with, I made sure this was clear to the debtor. I never had to file for contempt charges.
I propose that we as notaries in different parts of the country band together and implement this proceedure against the real scufflaws, ( Precision Signng Services) comes to mind. If the debtor with a history of chronic offenses is confronted in a court setting they will be less inclined to continue to cheat the notary of their due fee.
