check with your state whether or not a notary is to prove capacity and not just their ID. In Ca, we don't prove their capacity. |

This was a mortgage signing with a POA...problem was I was not told that. There were instructions on how to sign as a POA, but the examples were not quite clear. This was my first POA signing and when I reviewed it I thought I understood the instructions correctly, but apparently not. Even the BO thought that is how he should have signed. Now I will be returning to the BO's home to resign. Fustrated, but will move on. Lesson learned. I had a vibe about this and should have gone with my gut...not to mention it was a long day.

Was this a mortgage signing and did the party who hired you know about the POA? If you weren't told there would be a POA to sign for someone else, and there was no pre-printed wording for the POA, then it's possible the lender doesn't know and you should contact your hiring party immediately. If the lender didn't know, it could affect the funding of the loan. Check your state laws on whether you're required to see the signed POA before you notarize. A lot of states only require you to accept the word of the signer. |

I did a signing the other day whereas the wife was in another country and the husband signed her name with the verbiage following to state Attorney in Fact. I had no proof of this person or any paperwork showing he had rights to sign her name. I completed the signing, but wonder now if this was legal? Any thoughts
