I was called to notarize something at a nursing home a little out of my range. I was going to be in that town anyway, so this was a way to make a little extra. When I arrived, I decided to do a little promotion of my service, so I signed in as a notary. No one was at the front desk. I stopped by an office, asked where the room was, and handed out a card. I have gone to nursing homes for years. I was/am the only local notary who works after hours, and I don't mind having a situation in which I might not be able to notarize, therefore not getting paid for a trip.

As soon as the family and I were in the room, the social worker called me to the door, saying that the head nurse had real concerns about this person's lucidity. I started to assure her that I never notarize if the person doesn't understand the document but she wasn't listening. She was then criticized by a family member. The social worker then pretty much took over the situation, with the family member referencing a lawsuit that declared the resident capable of making decisions and the fact that the resident writes her own checks to the home each month. The end result was that the family member told me she'd pay me my entire fee and told the social worker that she was getting a lawyer.

When I got home, I told my husband that I thought afterwards that I could have closed the door and done my own interview with the resident, although I was certainly inclined to listen to staff. I said I thought the social worker took control rather than suggesting and that there is apparently a history between her and the family that I am not aware of. He agreed, saying that he thought the social worker is a busybody.
