The call wakes me up at 7:30 on Sunday morning. It's a rush, the lady who will be signing the POA is dying in a local hospital. Thru my wake up fog, I ask the usual questions.
It seems that my client, who says she is a NY notary, will be named as agent on the POA. But there are a few issues with the assignment.
The person granting the POA has no ID with her in the hospital. "But, that will not be an issue as I am a notary and can verify her ID". My caller wanted to both be named as agent and be a witness!
"I only have one POA form, can you provide some more?" I remind her that NY notaries may not provide or select forms to use. Again I ask her if she (the caller) is a NY State notary and she replies that she is.
I remind her that "subscribing witness" procedures require "personal knowledge" not just ID. The notary must "personally know" the subscribing witnesses. Also, she could not witness as she is named as agent on the POA.
Naturally, I could see this assignment was going nowhere, despite the critical situation of the person who would be granting the POA. There was no option for me other than to decline. Once again asking the right questions saves an unhappy trip for all concerned.
