Tyler,

I have never seen a Bailiff in the courtroom check the ID of a person about to testify. I personally require ID for this function. But, I am wondering if it is technically a requirement. They *ARE* sworn in prior to asking for their name. Just wondering.....

I recently experience this myself. The witness was in Stockton but the trial was in San Diego. She was told by a judge that she needed an Notary to validate her identity over the phone as she was going to give testimony regarding a bail hearing for a family member.

However, unlike Jeremy's and Ed's experiences after waiting an hour the judge push back the hearing to the next day. Then on that day he decided to grant bail without hearing the witness testimony. So my service ended up not being used after all. Thankfully the witness was understanding and still paid me for my time.

I'd do one of these any day, however I would also make sure the witness knows that payment is due whether the court decides the testimony is needed or not because in my situation it was a one hour window each time, and that one hour you're tied up not preforming signings or notarizations.

Took all of 10 minutes; everyone was on time. The Bailiff gave me a much cherished "Thank you Mr. Edelstein, well prepared". This is the script I used:

For the record, my name is Kenneth A Edelstein and I am a New York State notary public. I am qualified in New York County, and my commission number is 01ED7777777. My current commission expiration date is May 15, 2014.

I am swearing in ____________________________
who produced ________________________________
ID number ___________________________________
for my inspection.

Raise your right hand.


"Do you solemnly swear or affirm that the testimony you're about to give will be the truth, the whole truth and nothing but the truth, so help you God ?"

State your Name.

I've been called twice for this - first one I traveled 45 miles one way and sat for 15 minutes just to find out they settled and my serves were not needed; I got paid but I sorely underpriced that job.

Second one the guy was told to have a notary with him, and he did. I was there, he called the court and they swore him in over the phone!!! I already had my cert filled out so I swore him in too, completed the cert for him, collected my money and went my merry way..

I saw a post about this on NR a few days ago. I have done one of these. The witness was in Los Angeles... I was a Los Angeles notary in Los Angeles... the court was in Florida... What threw me was that they were on Central time! They were near the Alabama border and that part of Florida is on central time. OMG! In any case, we had to call the judge, wait for about 20 minutes, I swore her in, made her sign my journal and documented the whole affair, and then I was done!

I was offered some Filipino food -- eggs and sausage cooked in tomato sauce! You can't get more Asian that that!
