Huh, did not know this. Then again I don't believe I ever have notarized adoption documents. Good to know.

yes, most (if not all) adoption documents that are notarized require that the notary's commission expires in not less than 1 year from the date of signature. I guess this has to do with the international legal requirements and the fact that adoption paperwork takes a long time - so the adoption agency wants to make sure that the notary is still in business 1 year from the date of signing, in case it is required to confirm the validity of the signature, etc. Again, this is an adoption agency request rather than a legal requirement.

Yes, that happened to me once only in my case my commission expiration date had to be greater than 2years from the date of the notarization. I think the adoption agency that requested this was in India. |

Okay, so I was excited I have a large signature job in a doctor's office on Monday morning. The lady emailed me this tonight as follows:
Hi! I'm the one who called you to notarize something at my doctor's office on Monday at 11am. It's a medical letter for an adoption, and I just realized that I forgot to ask you when your commission expires. The agency requires that the notary's commission be good for at least one year after the date of notarization. If your commission expiration is after March 12, 2013, then we're good to go.
Has anyone ever come across this requirement before? It sounds like nonsense to me. I've never heard of this ever in the past 3 years I've been a notary. If I refuse to comply and show up for the appointment anyway to notarize the documents because my commission is valid, could I be held liable? I personally don't see how I could be considered doing anything wrong under these circumstances, that the request is unlawful by this agency that limits my commission to 3 years.
On the other hand if she personally chose a notary she wanted who had a later expiration date, that would be one thing. People do have that choice, but because she's made it some legal requirement of an agency, I at least want to find out what agency's she's referring too. It sounds like a government agency of some sort involving adoption.
Has anyone heard of this before?
