Acknowledgments represent roughly 80% of notary acts, making them by far the most popular. The purpose of an acknowledgment is to verify that a particular individual really did sign a particular document. Since a notary public is a trusted state official, they are one type of officer who can execute an acknowledgment.
Personally appear: The signer must personally appear before the notary to have their signature acknowledged. They can not send a friend to see the notary if they are busy. If the signer is in jail, they must be within a few feet of the notary, and direct communication must be possible.
Personally known The signer must be identified properly, and one way to be identified is to be personally known to the notary. This means that the notary should have met the individual many times and have met them in conjunction with others who stated the signer's name many times. Having seen an individual a few times and not really knowing their name doesn't constitute personal knowledge.
Satisfactory evidence. If a signer is not personally known to the notary, they can prove their identity on the basis of satisfactory evidence. This means either credible witnesses, (read about credible witnesses by clicking on the link below) http://www.123notary.com/forum/topic.asp?TOPIC_ID=4018
or a current government issued photo-ID with a signature and physical description. Driver's licenses are by far the most common form of identification that is acceptable for notaries.
The document. The signer can sign the document before they appear before the notary or while they are before the notary. By presenting the document, that constitues acknowledging that they signed it. The signer must also be named in the document.
The certificate The document can have the certificate wording embedded in the end of the document, or a loose acknowledgment certificate can be attached via a stapler. The notary needs to fill out the certificate including the venue (state, county info), the name of the signer, name of the notary, date of the notarization, signature of the notary, and lastly, the notary's official notary seal needs to be clearly affixed to the document.
