Most states have fines and penalties for notaries who break notary law. The worst penalties are for those who engage in fraud involving deeds to real property which could result in a felony. There are misdemeanors for other crimes. It is necessary to know all of the notary laws in your state and make sure you don't break any.

Notaries rarely get caught when they do something wrong, however, you could get caught at any time. You would be more likely to get caught if you did something that adversely affected another person. Notary divisions typically have fines for the more minor infractions. Fines for infractions in California are often $750 or $1500 per incident for many types of misconduct.

Typical misconduct could include:
Failure to administer an oath when required.
Selling your notary seal
Notarizing with an expired commission
Notarizing outside of your state's boundaries
Not having the signer present when acknowledging a signature
Failure to deliver journal to the county clerk when required
Counterfeiting a notary seal
Failure to secure a notary seal or journal
Failure to report a lost or damaged seal
Nonpayment of judgment
Delinquent on child support payments
Failure to keep proper journal entries
Creating a false notary certificate
Trying to influence a notary to do something illegal
Failure to obtain ID for a credible witness
Failure to get a thumbprint when required (CA)
Copying certificate of naturalization
Application mistatement
Dishonestry
Improper foreign language advertising
Advertising as an immigration consultant or expert.
Unlawful practice of law
Overcharging
False advertising
Making a false statement to a notary public
