I just this week decided to stop accepting work from the Tidewater / Premier Title Insurance Co. / Dominion Title / LT Caplan office for the same reasons. I was never shorted on payment from them, but I've had three files THIS YEAR that I did not get paid on - through no fault of my own. One was a no-sign. The second was when the lender pulled funding on the loan after I sent in a fully executed package. The third was just recently when the borrower used his 3-day RTC after I returned a fully executed package.
The first time I let it go because they were a good client of mine. By the second time I was feeling taken advantage of but still let it slide because I wanted to continue to receive work from them, however at that time I severely limited my coverage area for them and I did turn down quite a few jobs they called me for that were too far away. (As I'm sure you are aware, they don't pay extra for travel.) But this third time, I've reached my limit for good will and being a team player.
I was aware of their no-pay policy after the first incident, so I'm not going to pursue payment for this last one. I feel that their office is likely to find themselves without competent notaries willing to sign their loans if they continue this practice. I feel as if they do not value the good work I've done for them in the past. And I have saved many, many loans for them by recognizing errors with lender docs, and I feel like I was sandbagged once when I walked into a very sticky situation that I feel I should have been given a head's up on. I'm done.
P.S. They like to mention their "Notary Agreement" - I never signed that!!!

Fellow notaries: I have done work for this company (they are also known as Premier Title) many times over the past few years with no problems. However, they are now refusing to pay me for a signing I did for them and they also shorted me by $25 on another signing. They told me after I completed a signing for them that they don't pay if the loan doesn't close. I responded that I did not agree to that condition and still expected to be paid. In response to the demand letter I finally sent them, using the template from this site, I received an email from LT Caplan, head of the company and an attorney at law, stating "The reason we do not work with you anymore is because you are not a good person." He also accused me of "Threats, being rude, the poor way you (I) handled ... closings, etc are not a good way to handle yourself, clearly your reputation beholds you and this office does not want to be associated with a person of your kind." He also insinuated that I would be committing slander if I pursued collection against his company by contacting third parties about the matter. He didn't mention the $25 I didn't get paid for the signing that did close, but I'm taking his email to mean he doesn't intend to pay me. At this point, I'll be following up on my demand letter by taking the steps as outlined in the letter. I'm also going to file a complaint against him with the bar association. I just wanted to warn other notaries about this company as they clearly don't think they have to pay us for the work we do for them.
