Thanks everyone for the advice. I had a signing today for a loan in trust and hleped the borrower fill out the certification of trust by showing her a document with a signature line where she is to sign as a trustee and pointing out that it gives the name of the trust and the date it was established. And a few documents indicated that her trust was revocable. I checked with the lender beforehand and was told that it is alright if the borrower(s) cannot fill in every blank item in the documents- just fill it out to the best of their ability. |

To add: It says on the DOT - area where you normally see the vesting (for example): Minnie E. Mouse, Trustee of the Minnie E. Mouse Revocable Living Trust....date started (or created, established, or whatever word is used to show it's beginning) May 9, 1997.......
Just have the borrower copy that onto the Trust Certification form. The other questions on the TC form are self-explanatory. |

During a signing, the info for Trust Certification (name of trust, date it was created) is on the Deed of Trust.....just pull that out from the stack and the borrower can copy from it to fill in the Trust Certification form. The other questions on the TC form are self-explanatory. |

In Florida, that would probably be construed as UPL. If the signers have difficulty filling out any form with unique and specific information about them, the property, the loan, etc., the signers need to contact their LO/broker or title closer for assistance.

Whenever I do a signing for a loan in trust, the borrowers often are clueless about how to fill out the Certification of Trust, which asks for the important basic facts of the borrowers' trust such as the name of the trust, the date it was established, whether or not it is revocable, etc. In many cases it is not enough to just ask them to dig out their trust documentation and find out the information which is needed to fill in the blanks. They expect me to show them how to fill out this form, advise them if they are giving the correct information. How much can I help them without crossing the lines as to my capacity as a notary at a loan signing? |
