As Linda said, line out & initial things you don't agree to. Be sure to keep an annotated copy of the contract, showing all changes, date and time you submitted the changes, to whom you sent the changed agreement and how the changes were sent. Thus, if there is any comment about your contract, you have your copy to show what changes you made. Typically, contracts must be signed and signed copies delivered to each party to the contract. However, in reality, I have hardly ever received a signed copy of a contract from a signing service or other agency.
As for anyone requiring vehicle insurance, I support what Linda said. We are not hired for courier services. If we were, we would need commercial coverage. We are hired to perform a task (signing). How we get there is not a part of our job description. I know of signing agents in Manhattan that don't even own a car. Mass transit is alive and well in NYC. So the requirement, imo, is bogus. Further, it is up to individual states to determine what the minimum insurance requirements are for drivers.

I haven't seen that language in any of the agreements I've signed in the past - other than they're not responsible if anything happens as I'm an independent contractor and I understand they do not provide coverage to me, be it health, car or worker's compensation insurance. I did have one company once request a copy of my car insurance dec page which I refused to provide.
If it were me I'd line through everything after the first sentence and initial it. What coverage I carry is not their business and I won't have a company who does not employ me or who may never send me any work dictate how much insurance I carry.
But that's just me..

I signed up with my first signing company. This is the only little thing I had a problem with...
"You agree that if you or your employees operate a motor vehicle during the term of this Agreement, the Company is not responsible for any damage or loss sustained by the use of said vehicle during the term hereof. If you or your employees operate a motor vehicle in the performance of your duties hereunder, you will maintain public liability insurance in limits not less than $300,000/$500,000, and shall promptly furnish the company with documentation evidencing the same upon our request."
Do most signing companies request that you carry so much car insurance? Why should they care how much insurance I carry if it's not them that is responsible but myself? |
