This is a legal question and it should be asked to an attorney, not notaries. Notaries are only responsible for filling out simple paperwork and identifying signers, etc. If you need a notarized letter, then ask a notary for help completing the notary forms, etc.

If your friend is getting custody of the relative, then the court order from the judge should be sufficient, and she wouldn't need a notarized letter.

The judge will give your friend a temporary custody order, if this is a temporary placement, and she should take this order along with I.D. to the school, which should be sufficient enough to enroll the relative. But she should call the school to see what exactly is needed.

I suspect Linda's point was missed - and her advice was right on target. The initial question wasn't asking about whether or not a notarization could be performed - but was refering to issues beyond the scope of a notary (friend or not).

It's not our call to advise anyone whether or not they have the correct form for their purposes, or whether of not the form they have is legally satisfactory for whatever their needs are.

IMHO anyone can get a notarized letter. I have done hundreds of custodies in New Hampshire and always had to have some kind of a Motion or Judge's Order for enrollment purposes.

This is not to be construed as legal advise as I am not an attorney.

Not enough information to give you a complete and thorough answer, Nina, but enough information to know that's not your call to make. Your friend needs to do her research and find out what is required to "make it legal" and she needs to find out exactly what she needs to do to enroll her in school. You can notarize her signature on the docs she signs but you can't provide the documents/forms or give her any advice about them - unless you're an attorney.

My suggestion is refer her to the local school board for the enrollment requirements and, to "make it legal"?? - refer her to an attorney or to legal aid if she can't afford one.

I have a friend that will be receiving custody of a family member. She would like me to notarize the letter. Is there a certain form that she needs to bring me to make it legal? A certain legal form for custody? Or is the notarized letter sufficient enough to let her enroll her in school and such?
