Unlike several other states, Kansas does not include conducting marriage ceremonies as a part of Notary duties. However, several Affidavits of Continuing Marriage have been included in loan packages where only common law marriages have existed. It has raised some interesting conversation between the TC and the borrowers in this Dower State.

Perhaps even more interesting has been the statements made just before signing in one or two of these. One young man said, "If I sign this does it mean we are really married?" His wife said, "You've got five seconds before me and the kids are leaving!"

Affidavits can be used in many different situations, however the bottom line in all instances is...

It's a statement under oath, sworn to by the person(s) signing...usually requires a Jurat.

An affidavit is a statement of truth sworn to by the affiant.

Please tell all you know about affidavits. There are so many types. Its not our job as notaries to understand documents, but, just for fun discussing this, we can talk about it. Affidavits can be used for business transactions. Immigration documentation includes an affidavit of support. Its common for people traveling to sign an affidavit of citizenship too. What are your experiences?
