Hello,
I am in Texas and I have a few questions for your guys and hopefully you can help me answer them.
I know about the Notary Public industry, rules, regulations and laws. That's not my problem.
Recently within a few weeks, I decided to be a Certified Signing Agent and I am confused as to this whole ordeal with E&O.
I am bonded and insured for Notary Public. Bonded for $10,000 since its the min. here in Texas, but insured with E&O for $100,000. Never used since 2002 been a Notary Public, knock on wood.
My questions is: Do you have to have E&O for Signing Agent? I am just beginning and the cost is per year not like the Notary Public for the 4 year term thats more afforadable and doable. Does the E&O for Notary Public cover your Signing Agent as well???
Are there companies that offer this, if so who, how much and do you really have to have it? Also, what is the going coverage to get jobs?
I appreciate your help and I hope that I can get some answers, really lost and confused.

Hi Jessica:
I hope you've looked into this further than E&O in Texas. I hope you've researched how the signing agent profession works in your state. Such as (a) some signings in Texas, such as cash-outs and HELOCS, *MUST* be signed at a title company or attorney office (which will require you pay a fee to them for use of an office) or at a branch of the lender; (b) your constitution *REQUIRES* that you provide the signers with not just a copy of the documents they've signed, but a *copy of the SIGNED documents*..
Texas is different in many other ways too, all of which you will need to be familiar with before hanging out your Signing Agent shingle. I'd suggest you go to Brenda Stone's website for some of the best Texas Signing Agent information you'll find around. Google her - I'm sure she's there.
Good Luck.

There are no requirements for performing as a signing agent, except you must be a duly commissioned notary public.
Your notary E&O will only cover the notarial parts of a signing, which is about 10% of what you need to do. Read your policy carefully and you will see that it is very limited in the coverage. As far as getting Signing Agent E&O, CNA Surety is the only company that I know of that is writing SA E&O. You can check it out at http://www.signingagenteando.npuonline.com/
