In the case of a personal loan or a loan to purchase property this would be true, and I'm assuming this is what this agent was referring to - at least I hope it is. In the case of a refinance, docs are drawn according to how the borrowers took title, which is already of record in the county recordings and is determined by the title search.
Anyone who takes title to property and subsequently changes their name, and thus their ID, should really think about also changing the name on the title to all the property they own - would sure make life a lot simpler for notaries!

Over the years I have researched this. "Paul Michael Stone, Jr." can be 'less than whats on the ID but not more than or different than'. So, Paul M Stone is ok, or P. M.Stone is ok. If docs have 'Jr' on them but the ID doesnt or for any other discrepancy, I always notarize with the name as it appears on the ID. The state of Calif is my boss and thats what they say. If they dont have the docs right or its different than the ID, thats not on us as notaries. I do my part right. I usually verify what name appears on their ID when I call to confirm the appt telling them that I want to make sure they have the docs right. They usually cooperate. I will notify the signing agency of any differences and tell them how I will be notarizing it- according to the ID. Lately, I am so burned out on dealing with trying to make it right that I just concentrate on notarizing the name of the signer according to the ID regardless of how they signed. Thats my job and the rest isnt our problem. Sorry.

So I just notarize according to the ID which is our job and the law and our first obligation. Being a "Signing Agent" doesnt give us any special dispensations for bending or altering anything becuase we work in the lending industry and are expected to be accomodating. As far as punishment, it is a felony with a $10,000. fine for not following the ID. |

I am not sure what is the law in Fl, but in California it's a big deal.
I like to know would you sign a doc that the name has "Jr." in the ID and not in doc or vice versa?

So what makes you think the names don't match? I would guestimate that about half the American public has driver's license with a different name than what's on title to their homes or vehicles.

I would like to know what would be the fine and or punishment to notarizing a doc which the name does not match with ID.
Example:
Name on ID says " Paul Michael Stone,Jr." and the name on doc says "Paul M. Stone"
