I would check the reason behind the requirement for “at least 1 year commission expiration” for adoption paperwork.
I believe that the reason behind this requirement is that adoption process takes some time to complete (sometimes 1 year or more), and they want to make sure that the original notary is still in business when the adoption process is final…. (That’s just my opinion, and you could check with the adoption agency);

Let the hiring party tell you what their requirements are regarding commission expiration. Cite your state website http://vermont-archives.org/notary/faq/notaryfaq.html so they can see for themselves. Let the hiring party or document originator figure out an alternative.

As far as referring them to another notary, think about this - if you're called in Vermont, unless you're going to refer them to an out-of-state notary it will do no good to refer it to another notary - that notary's commission is under the same restrictions as yours. Your signers may end up traveling to another state where the commissions have different expiration dates.

I have not notarized any adoption paperwork so far, but just to be prepared, I would like to clear this up. I understand that the foreign agencies involved often require that the notary's commission will be valid for a year, or sometimes more, after the date of notarization. But in Vermont, all current commissions expire February 10, 2011 (except for ex-officio notaries, who might expire earlier). So if asked, I wouldn't be able to do the notarization, nor could I refer the client to a different notary. Suggestions?
