Sometimes the signer refuses to sign.
What do you do?
This is America and the signer has the freedom not to sign.

Just grab the main copies of the loan and leave.
The borrower gets their copies.

But, what if a borrower if just do damn slow and you have other commitments. Tell them that you have to go at 8:15 whether the loan is signed or not. If they reach the time limit and they don't sign, you will leave, take the documents, and they can reschedule.

Will you get paid for this type of partial-sign?
Whose fault is it if this happens?

That depends on the agreement which you have with the signing company. Most notaries don't have their own agreement, they sign the one the signing company gives them which defends the needs of the signing companies, not the notary.

Once.

It was a matter of personal safety. I was on location and the borrower was running late. I had waited 45 min for the borrower. Then I learned of the start of, and the forecast for much more - of freezing rain. That condition really scares me. I was in the Bronx (NY City) and the location was at the top of a very steep hill. As the ice started to cover my car and the roadway; I "threw in the towel" - picked up the docs and told the borrower's family that I had to go. About half an hour later (now 90 minutes late) the borrower finally arrived. The Title Co. called me and insisted that I return to complete the job! It took a lot of restraint on my part (after explaining why I left) - to deal with Title's total lack of concern for my safety. "I don't care a bit what the conditions are - you committed to do the assignment - I demand you return immediately". Even after I explained the radio was full of crash reports! Finally I just told Title that I was unwilling to die for a signing fee. Title continued to scream, threaten legal action, curse and rant. When their profanity became incessant; that justified my termination of the call with a polite "Sorry, I am almost home and must concentrate on driving on these ice covered roads". It still amazes me that someone could be so concerned about a redraw, or even loss of commission that they would demand I risk my life for a signing.

The strangest mid closing "grab the documents and leave" that I had was years ago durring the mortgage boom. I was closing at a title company office, but it was a courtesy for another title company, not the title company where the office I was at.

I got a call about 3/4 through the documents. "Don't ask any questions, just take the documents and call me when you get to your car."

Apparently, the title company did a last minute title search and found out the guy had sold the property and was just trying to get a second cashout.

Hello,
Years ago, just starting out, I was closing a refi loan where the husband was cashing out to pay off his wife. They were getting divorced.When I got there, I could feel there was hostility in the air.The wife imediately wanted to see the check she was getting.I told her there was a three day right of recission and she would have to wait till day four. Well, this woman freaked out on me and called me every name in the book. I told her if she didn't calm down, I would leave. That just made things worse, so I tried to grab the loan documents and leave but she ripped them out of my hands.I didn't feel like getting into a fist fight with this woman, so I relinquished the docs and left.I called the signing service and they said " they were afraid something like this would happen". Would have been nice if they told me. Whenever I confirm a closing and am informed it is a Domestic situation, I inquire as to the civility of th situation and remind the borrower that I expect everyone to act like adults.I've Done plenty of Domestics since tham and have never had a problem. Experience counts...

I have had a few signings where the "numbers" did not add up, and the borrower refused to sign. I left with no fee paid, after letting the signing company know.

If the borrower was taking too long, (which happens a lot) I let the next appt know I will be running late. Most of the time, they are understanding.
