Posted - 07/26/2011 : 3:01:40 PM NJ has isuued the following: Governor Chris Christie • Lt.Governor Kim Guadagno Search All of NJ Treasury Revenue NJBGS NOTICE CONCERNING ONLINE NOTARY SERVICES UTILIZING A WEB CAM OR OTHER*****EQUIPMENT The Division of Revenue requested legal guidance concerning the practice of online notarization services utilizing a webcam or other*****in lieu of a personal appearance in front of a valid New Jersey Notary. It has been determined that New Jersey’s statutes do not allow for this type of notarization.

Posted - 07/27/2011 : 04:45:14 AM In lieu of this ruling I request that 123Notary drop their listing as they state on their web site:
"You make an oath of affirmation that vouches for the truthfulness of any and all signings completed on this Site. You acknowledge that any electronic signing, oath, or affirmation conducted on or by the Site or by a Notary has the same legal force and effect as if done in the physical presence of the Notary, and that the SignNow method and/or the use of webcamera to appear before a notary satisfies any requirement for appearance or personal appearance, including any applicable requirement in New Jersey Statute 46:14-2.1, 12A:12-11, and/or 3B:2-6. You agree that this signature and notarization are performed in the state where the notary is located. At this time, this means that only the state laws of New Jersey shall apply. You acknowledge that nothing on this site can be construed to indicate advertising or offering services to individuals in states that may consider this activity illegal"
This statement is a CLEAR violation of NJ law
