Posted - 03/30/2008 : 4:02:07 PM I'm adding to Ken's discussion about Florida here. My idea was to have an "affidavit of single manliness" to prove that a man is single. The man could sign and swear to such a document. What do you guys think? Is that proof enough to get the notary off the hook for notarizing a certificate with a marriage status on it? |

However, without doing a search of the court records to make sure there's not a divorce thrown in the mix, the above is hardly conclusive.
And the search would have to be literally worldwide. I contend there is NO WAY for anyone to prove to me their marital status. The sole possible exception would be for me to actually be at the marriage ceremony. But even then I for one would not, under my seal, make any statement as to their marital status. With apologies to Johnny Manthis: "It's not for me to say...."

Posted - 04/07/2008 : 02:14:17 AM I'm thinking this thread was mostly tongue-in-cheek
Most states prohibit notaries from certifying capacity, and that would include marital status. Loan docs have statements of marital status, as well as statements regarding other parties having title interest all over the place. Some are notarized, others (like the 1003) are not. The 1003 does also state above the signature "under penalty of perjury" for good measure.
You can't ever prove a negative - there would be no way to prove someone is not married, or not single - much to the dismay of countless women out there in the dating scene! |

Posted - 03/30/2008 : 8:51:23 PM I agree. The affidavit might prove he was single. But, would it really prove if he was manly? |

Posted - 03/30/2008 : 4:13:34 PM That would be up to each state SOS to determine. But I'll be Damned if I'll swear to ANYONE's manliness!!...hehe
