Liliana did fill out the aka, title company sent me out with a corrective quit claim deed to get the name right on title. The brokers docs had her name correct from the beginning. Title showed Lillian and was never corrected. Since I showed her correct name on the affadavit they were fine with it. I just not going to put myself in this situation again. I think I will make a habit of verifying the names before I get there.

Lilliana presents I.D. to prove she is Lilliana. Lilliana fills out a name affidavit stating she is aka Lillian.

If the documents say Lillian and the ID says Lilliana, how can you prove or know they are the same person?

Your purpose as a notary is to be certain that the person signing is the person named on the documents. I don't see that you are able to prove that. Lillian is not the same as Lilliana.

IMO.

Now had you been able to get ahold of the TC, they may have instructed you to have borr line thru each printed name, insert correct spelling and initial. I have had them instruct me that way, but that is not a call you can make. IMO.

Nothing in my posts should be construed as legal advice. I am not a licensed attorney in any state.

I have always been under the understanding that the notary wording should be just as it is printed on the docs but just show the name on the signature aka. Am I suppose to write in the name as it is on the docs or write it as it is on the id.

Lilliana and Lillian are two different names which could mean two different people. If the loan were mine to sign, I would not do it until it was corrected.

Furthermore, the identification Lilliana presents you with should be clear enough to validate her correct identity. I personally would not sign the loan as you have to notate her correct name in your acknowlegment which is different than the name on the documents.

If the person name is Lilliana and most of the docs have Lillian do you just show the correction on the same name aka or through out the loan does the borrower need to add the (a) and initial. Title company left before the docs were checked.
