Obtaining instructions on how to perform your duties from a BORROWER would never be the best decision

Read through your state's Notary Act - the ACTUAL law, not someone else's interpretation of it. Read it over enough times to feel familiar and confident - and don't let anyone intimidate you or bully you into compromising it. Confidence in knowing your statutes is your absolute best and most crucial 'tool' to doing this job.

My very basic understanding of CA's statutes regarding CW's is that it must be "difficult or impossible" for the person to obtain proper ID. I doubt you could convince a judge that this person faced a "difficult or impossible" situation. Whenever I face a 'gray area', I ask myself "how would I present this to the judge, if I ended up in court?" If I truly believe I am using best practices, due dilegence, and believe I could stand in court and tell a judge what I decided with confidence - then it's a go. If not, game over.

People lose their ID's all the time. Old people often have expired ID's if they don't leave the house much. Its good to be familiar with doing signings with credible witnesses. Please learn your state's rules for credible witnesses by researching a law primer or reading your states notary laws. the biggest problem with credible witnesses is timing. If its too early they are at work, if its too late then they are asleep. Otherwise, just try to disturb them during dinner and then if you are lucky they will come right after dinner.

I went to do a signing, Borrower lost all ID, SS card 3 weeks ago. Borrower said I could use CW, because 6 months ago when he refinance the other notary use them. My question is why the hell he didn't apply for a new ID. Well... I use the CW must now I fell like is not right!
