That depends - I assume you're talking about a loan package - what did they refuse to sign?

Example: A Continuous Marriage Affidavit included in the package for a widow/widower...if borrower refuses to sign that then I'd just return it to title/lender with the rest of the signed package with a note attached as to why it's not signed. Or...the debit authorization usually included in the package allowing for payments to be directly debited from their checking account - almost all my borrowers refuse to sign that one. I just send that back unsigned but let borrower know they have a copy in their package if they change their mind.

However, if the borrower is picking and choosing what documents he/she will or won't sign, I'd adjourn the signing, pick up my toys (in this case the documents) and go home...explain to the borrower that if they refuse to sign all the docs provided then I can't continue and we'll have to take it up with title the next business day. I'd then charge a no-sign fee (my policy for that is 50% of agreed fee). Then another fee for the return trip once title sets borrower straight about how to sign the docs.

What should I do if customer refuses to sign all the forms. lender cannot be reached or title company. Does the notary still expect payment or do I call this a brought lesson?
